Diversi merupakan suatu mekanisme yang memugkinkan anak dialihkan dari proses peradilan menuju proses pelayanan sosial dengan ketentuan syarat yang harus dipenuhi melalui pendekatan keadilan restoratif atau musyawarah. Keberhasilan dalam pelaksanaan diversi melalui pendekatan keadilan restoratif adalah dengan terlibatnya seluruh pihak yang terlibat dalam mengimplementasikan pelaksanaan diversi dan kesepakatan diversi yang dihasilkan dari proses musyawarah.Penelitian ini bertujuan untuk mengetahui bagaimana proses pelaksanaan diversi melalui pendekatan restorative justice berdasarkan tiga sapek meliputi 1) Aspek pelaksanaan diversi ABH melalui restorative justice di tahap penyidikan, 2) Aspek diversi ABH melalui restorative justice di tahap penuntutan, dan 3) Aspek pelaksanaan diversi ABH melalui restorative justice di tahap pemeriksaan perkara anak. Metode penelitian yang digunakan adalah deskriptif kualitatif. Penarikan sampel dalam penelitian ini menggunakan teknik purposive sampling sehingga terjaring lima informan yang berasal dari pembimbing kemasyarakatan Bapas Kelas I Bandung, pekerja sosial koreksional Dinas Sosial Kota Bandung, dan klien Anak Berhadapan dengan Hukum (ABH) di Bapas Kelas I Bandung. Teknik pengumpulan data dilakukan melalui wawancara mendalam dan studi dokumentasi. Hasil penelitian menunjukkan bahwa ketiga aspek belum terlaksana dengan baik karena masih terdapat beberapa hambatan dalam prosesnya di tiap-tiap tahap karena: 1) Pembimbing kemasyarakatan belum mempunyai keterampilan dalam melakukan pendekatan terhadap anak dan keluarga. 2) Belum terdapat program untuk pengembangan kapasitas pembimbing kemasyarakatan anak. 3) Kurangnya pemahaman ABH dan keluarga tentang diversi melalui RJ. 4)Waktu pelaksanaan diversi yang tidak menentu. Berdasarkan hasil penelitian tersebut, peneliti mengususlkan suatu program intervensi yaitu program “Pengembangan Kapasitas Pembimbing Kemasyarakatan dalam Pelaksanaan Diversi Anak Berhadapan dengan Hukum Melalui Pendekatan Restorative justice.” Dengan tujuan untuk meningkatkan kinerja pembimbing kemasyarakatan dalam penanganan diversi ABH melalui restorative justice di Balai Pemasyarakatan Kelas I Bandung.

Diversion is a mechanism that allows children to be diverted from the judicial process to the social service process with the provision of conditions that must be met through a restorative justice approach or deliberation. The success of implementing diversion through a restorative justice approach is through the involvement of all parties involved in implementing the implementation of diversion and the diversion agreement resulting from the deliberation process. This study aims to determine how the process of implementing diversion through a restorative justice approach is based on three aspects including 1) Aspects of implementing ABH diversion through restorative justice at the investigation stage, 2) Aspects of ABH diversion through restorative justice at the prosecution stage, and 3) Aspects of implementing ABH diversion through restorative justice at the stage of examining children's cases. The research method used is descriptive qualitative. Sampling in this study used a purposive sampling technique so that five informants were collected from community counselors at Bapas Class I Bandung, correctional social workers at the Bandung City Social Service, and clients of Children in Conflict with the Law (ABH) at Bapas Class I Bandung. Data collection techniques were carried out through in-depth interviews and documentation studies. The results of the study indicate that the three aspects have not been implemented properly because there are still several obstacles in the process at each stage because: 1) Community counselors do not yet have the skills to approach children and families. 2) There is no program for developing the capacity of community counselors for children. 3) Lack of understanding of ABH and families about diversion through RJ. 4) The implementation time of diversion is uncertain. Based on the results of the study, the researcher proposed an intervention program, namely the program "Developing the Capacity of Community Counselors in the Implementation of Diversion for Children in Conflict with the Law Through a Restorative Justice Approach." With the aim of improving the performance of community counselors in handling ABH diversion through restorative justice at the Class I Bandung Correctional Center.
